What is title insurance — and why do I need it?

Many buyers overlook it, but title insurance protects both you and your lender from losses stemming from defects in the property's title.

Why it matters

Defects can range from improperly recorded documents to forgery, easements, or encroachments. If someone claims ownership or a defect is discovered, title insurance shields you from the resulting losses — potentially hundreds of thousands of dollars, and even your home.

How much it costs

A one-time, up-front fee — not an ongoing expense. An owner's policy is based on the home's price; a lender's on the loan amount. Together they usually cost about 0.5%–1.0% of the purchase price — roughly $1,500–$3,000 on a $300,000 home, per ALTA.

Who pays

The buyer pays for the lender's policy as part of closing costs. Either buyer or seller can pay for the owner's policy — local custom often decides. Buying both at once can reduce the owner's cost through a "simultaneous issue" charge.

A title policy covers underlying issues with a property's title that might have been missed before you bought the home — for example, if a public-record search failed to catch a lien or ownership dispute.

Title insurance doesn't protect against every possible infringement on your property rights. It won't cover problems caused by your own actions — such as failing to pay a contractor who replaced your roof, or not paying your property taxes. It also doesn't protect against eminent domain, when a government seizes private property for a public purpose. In short, it doesn't protect against issues newly created after you buy — it protects against issues that existed before, and might have affected your decision to purchase had you known.

Title insurance isn't just important — a lender's policy is required to protect their interest in the property. And an owner's policy is strongly recommended: without it, you could face significant financial liability if a defect or ownership claim surfaces.
